I was meeting a girl who turned out to be a police officer. They searched my car and found 2-3 grams of weed when I was detained. They want me to wear a wire and buy some weed. This never happened they said. I agreed and was supposed to call after a few days. I was told that I didn't call by Tuesday there would be a warrant out for me. Then I was given my pistol back and was let go. There was no mention of any charges but I don't feel safe wearing a wire. What should I do? What kind of charges can I face if I decline?
It depends on multiple factors, possession of weed alone is minor (if it was a personal amount) (Class B Misdemeanor in Texas for the amount you claim in the question). A class B has a fine up to $2000 and Jail not to exceed 180 days. BUT . . . there is always a BUT . . . if this occurred near a school that is worse, if it happened on Federal property, all bets are off, if the DA pleads and establishes the pistol was used in the commission of a crime (possession is a crime) that changes things too.
You should meet with a lawyer immediately. Agreements with police officers are not binding - if the prosecutor gets wind of the activity in which you engaged, they can file charges despite your agreement with the cops and even if you fulfill their request. The marijuana case would be a class b misdemeanor which carries up to 6 months in jail & up to a $2,000 fine (and if convicted, a driver's license suspension.) I question whether it is worth risking your life for the charge not to be filed. Talk to a lawyer first to get a better understanding and make your decision.
They are offering you a plea bargain. If you do it, they may make your own charges be lesser or go away, depends on yalls deal. But no one can force you to wear a wire. If you don't, you just look at the original charges they had on you. Hire an attorney asap and let him/her know about all this coercion. It's not good.
