I'm not really sure what you mean by this, but I'm gong to assume this is a case that got filed and then dismissed for insufficient evidence, and not where you just personally feel there's. I evidence, but the case is still pending or you were convicted. If the case was dismissed, you should be eligible for an expunction, which will remove the arrest and court case from your official criminal history records. Depending on whether the statute of limitations has run, whether the case was actually filed in court at all, and whether there really was "no" evidence or there just wasn't enough evidence for the prosecutor to want to go to trial, you may or may not be able to get the expunction immediately.
