What do I need to do to get this reduced to dry reckless?

I was arrested for DUI, breathalyzer 0.19, no accident, no kids involved, polite to officers, took my license, but never mirandized me. I have no criminal record. What do I need to do to get this reduced to dry reckless? I'm a teacher.

You must have a lawyer represent you. The willingness of the State to reduce the charges depends on the county. Such a reduction would never happen in Harris County but it easily could in other counties.

Need to try to see if DA is even willing to consider that as option. No set thing you can do.

I don't think we have that in Texas. That is usually a California plea deal.

If you blew a 0.19 (over double the legal limit in Texas) the chances of getting the charge dropped to a mere reckless driving is similar to winning the lottery. Not impossible, but don't bet your life on it. That said, I am answering the question the way you asked it. Can you fight and challenge the Breath Test, Field Sobriety Test, etc? Absolutely. Will you win? I would have to see the video, the intoxilyzer printout and calibration records, check the operator's certification, etc before having any opinion one way or another. Best thing you can do is hire a lawyer ASAP.
